1. Acceptance of Terms
By using services provided by Criterion Services, Inc. (“Criterion,” “we,” “us,” or “our”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use our services.
2. Services Provided
Criterion provides but is not limited to:

DOT and non-DOT drug and alcohol testing
-
DNA and paternity testing
-
Occupational health physicals (including DOT exams and HPEs)
-
On-demand laboratory services (CBC, CMP, lipid, PSA, etc.)
-
Compliance and program management services (FMCSA, OSHA, Drug-Free Workplace, TPA coordination)
3. Eligibility

Services are available to individuals, employers, attorneys, agencies, and organizations.

You must be at least 18 years of age to contract for services. Minors may receive services (e.g., DNA testing) with parental/guardian consent.
4. Payment & Fees
-
Payment is due at the time of service unless otherwise arranged.

Accepted forms: credit/debit, cash, business invoicing (with prior approval).

Unpaid balances may result in suspension of services until resolved.

Fees for specialized testing are non-refundable once collection has occurred.
5. Confidentiality & Privacy

All services are subject to HIPAA, DOT, and state confidentiality requirements.

Results are released only to authorized parties as designated in writing.

We may disclose information as required by law, regulation, or court order.
6. Medical & Legal Disclaimer

Criterion is not a primary care provider or law firm.

Services and results are provided for compliance, occupational health, or legal support purposes and are not a substitute for medical advice, diagnosis, or treatment.

Clients should consult licensed professionals for medical or legal decisions.
7. Client Responsibilities
-
Provide accurate information at time of service.

Follow all instructions during collections/exams (failure may result in test cancellation or being marked as a refusal under DOT guidelines).

Ensure correct chain-of-custody documentation.
8. Limitations of Liability
-
Criterion is not liable for indirect or consequential damages arising from use of our services.

We are not responsible for employer or legal decisions made using test results.

Accuracy and turnaround times are dependent on laboratory and third-party vendors.
9. Compliance with Regulations
-
DOT services are performed in accordance with 49 CFR Part 40 and FMCSA regulations.

DNA and lab testing comply with CLIA-waived standards where applicable.

Clients agree not to misuse results or represent them beyond their intended purpose.
10. Dispute Resolution
-
Any dispute shall first be addressed through good faith negotiation.

If unresolved, disputes shall be settled under the laws of the State of Tennessee.
11. Changes to Terms
Criterion reserves the right to update these Terms at any time. Continued use of services after changes constitutes acceptance.
12. Refunds and Cancellations.
Once a test is performed, there are no refunds. We do not charge for cancellations.
